Acceptable Use Policy

Ovation is for understanding a creator’s own supported public feedback—not for surveillance, harassment, deception, or high-impact profiling.

1. Purpose and scope

This policy is part of the Terms of Service. It applies to every use of Ovation, including profile submission, public-source analysis, source connections, automated results, exports, and attempts to access the Service.

Examples below are not exhaustive. A use may be prohibited when it creates substantially similar legal, safety, privacy, platform, or security risk.

2. Use only profiles you are authorized to analyze

You may submit or connect only a creator profile, handle, URL, or account that you:

  • own or personally control;
  • manage with the owner’s informed permission; or
  • are otherwise legally authorized to analyze for the requested purpose.

You must answer account-ownership and authorization prompts truthfully. You may not use a public handle to bypass this requirement, create a dossier about an unrelated person, or monitor a former partner, employee, applicant, student, customer, critic, or competitor without a lawful and permitted basis.

3. Respect people, privacy, and safety

You may not use Ovation to:

  • analyze, target, profile, or monitor a child or anyone you know is under 18;
  • harass, threaten, stalk, shame, intimidate, exploit, or facilitate violence against a person or group;
  • find, expose, infer, combine, or publish private contact details, precise location, credentials, government identifiers, financial information, health information, or other highly sensitive data;
  • infer a person’s protected or highly sensitive traits, including race or ethnicity, religion, health or disability, sexual orientation, gender identity, citizenship, genetic information, or political affiliation;
  • present an automated sentiment, score, verdict, or summary as a verified fact about a person or as proof of anyone’s private thoughts;
  • create deceptive, defamatory, impersonating, sexually exploitative, or unlawfully discriminatory material;
  • circumvent a source author’s deletion, privacy choice, block, or access restriction; or
  • retaliate against a commenter or audience member based on an Ovation result.

4. No sole use for high-impact decisions

Ovation results are automated estimates designed for creator self-reflection. They may not be used as the sole or determinative basis for a decision involving:

  • employment, worker monitoring, hiring, discipline, or termination;
  • credit, lending, insurance, housing, or essential services;
  • education admission, grading, or student discipline;
  • health care, mental health, medical diagnosis, or treatment;
  • legal rights, immigration, law enforcement, or criminal justice; or
  • another decision likely to create a similarly significant effect on a person.

Do not rely on Ovation as professional advice or a guarantee of reputation, audience intent, safety, or future success.

5. Platform rules, intellectual property, and source content

You must follow the rules of every source platform and respect copyright, trademark, publicity, database, contractual, and other rights. You may not:

  • submit content you do not have the right to use;
  • remove attribution, ownership notices, or source links;
  • download, republish, sell, or build a substitute database from source comments or other third-party content;
  • use unofficial scraping, stolen tokens, credential sharing, or access-control circumvention through Ovation;
  • ask Ovation to retrieve private messages, restricted posts, non-public account data, or other information outside approved permissions; or
  • submit an unsupported platform or ask Ovation to bypass the published platform and access limits.

If a platform or rights holder restricts or removes content, you may not use an old Ovation result to evade that choice.

6. No technical or service abuse

You may not:

  • probe, scan, or test a vulnerability except through the coordinated process on the Security page;
  • defeat authentication, authorization, rate limits, plan limits, source restrictions, or security controls;
  • introduce malware, destructive code, credential theft, denial-of-service traffic, or harmful automation;
  • reverse engineer the Service except to the limited extent applicable law expressly permits;
  • use bots or scripts that impose unreasonable load or create accounts, scans, refunds, or requests at scale without written permission;
  • resell, sublicense, mirror, or provide shared access to the Service without a written agreement;
  • interfere with another user, source connection, or account; or
  • use the Service to develop or benchmark a competing model or service through extraction of protected outputs, except where law does not permit this restriction.

7. No fraud, spam, or deceptive commercial use

You may not use Ovation to:

  • commit fraud, evade a payment obligation, abuse a refund, or misrepresent your identity or authority;
  • send spam, phishing, deceptive endorsements, fake engagement, or unwanted bulk communications;
  • claim that Swaynexa, Ovation, a platform, or a creator endorses a result, product, campaign, or user without written permission;
  • manipulate an audience, hide material sponsorship, or fabricate testimonials or source comments; or
  • violate sanctions, export controls, anti-bribery, consumer-protection, privacy, or other applicable law.

8. Enforcement

Swaynexa may investigate suspected violations and take proportionate action, including limiting a scan, removing a saved result, revoking a connection, preserving relevant security records, suspending an account, terminating access, or reporting conduct where legally required.

Where practical and safe, we will provide notice and an opportunity to correct a violation. We may act immediately when needed to protect a person, source platform, system, legal obligation, or investigation. We may consider context, severity, history, intent, and remediation.

9. Report misuse or challenge a result

Email help@swaynexa.com with “Ovation abuse report” in the subject.

Include the relevant Ovation URL or account, source URL, a concise explanation, and how we may contact you. Do not send passwords, full payment-card numbers, or unnecessary sensitive information.

If the report concerns immediate danger, contact the appropriate local emergency service first. Email is not monitored as an emergency channel.
